SB 569 Readiness Checklist: Design a Compliant, Sustainable Virtual or Hybrid Program in Texas

Texas districts are moving quickly to expand virtual and hybrid options—while making sure programs align to SB 569 and TEA guidance. Use this streamlined checklist to kick off planning, spot gaps early, and document the pieces that matter most. 

 

1) Program Model and Structure

▢  Confirm your delivery type: Identify whether you’re offering virtual/hybrid courses or a full-time virtual/hybrid campus

▢  Verify your model matches the statutory definitions (including the <90% in-person threshold for “full-time hybrid program”)

▢  Define the student experience: schedule, pacing, support, and expectations

▢  Identify who your program will serve - credit recovery, acceleration, enrollment recovery, medically fragile, etc. 

 

2) Course Requirements and Instructional Quality

▢  Ensure every course is TEKS-aligned

▢  Confirm courses meet National Standards for Quality Online Courses and TEKS -aligned instruction

▢  Ensure courses for students receiving accommodations meet requirements consistent with IDEA/Section 504/TEC

 

3) Family and Student Transparency

▢  Provide clear course/program information at enrollment and scheduling

▢  Document opt-in/choice processes and communications

 

4) Staffing and Teacher Readiness

▢  Define teacher-of-record responsibilities - instruction, grading, progress monitoring

▢  Confirm training/PD for virtual/hybrid instruction

▢  Establish staffing coverage for intervention, accommodations, and student support

 

5) Attendance, Minutes, and Audit-Ready Documentation

▢  Confirm operational minutes and daily instructional time expectations for your model

▢  Set a daily attendance policy  - what counts as “access to instruction”

▢  Choose your evidence sources - LMS activity, check-ins, work completion -  and standardize documentation

▢  Align LMS/SIS/PEIMS processes so attendance is consistent and auditable

 

6) Assessments and Testing Logistics

▢  Plan for state assessment administration requirements including accommodations

▢  Confirm test-site logistics, devices, proctoring, and schedules

 

7) Systems and Implementation-Ready Supports

▢  Align systems: LMS, gradebook, communications, reporting

▢  Build an intervention/MTSS plan for virtual/hybrid learners for students who fall behind

▢  Establish routines that drive engagement - weekly check-ins, pacing, progress reviews
